English translation of Continuity of Enterprises Act I

Over the past few years the practice of pre-packaged bankruptcy asset sales (‘pre-packs’) has soared in the Netherlands. To regulate this practice, in 2015 the Dutch legislator submitted a bill, named the Continuity of Enterprises Act I. In light of the importance of this bill for Dutch bankruptcy practice and cross-border insolvencies, Houthoff has prepared an English language version of this bill, a Memorandum of Amendment and the Explanatory Memorandum.
